Acceptance of the present conditions
By
confirming an order placed on the Cave de Bissey Web site, the
customer fully accepts all of the present sales conditions in
their entirety.
Order
The
information submitted by the customer at the time of placing an
order is binding. The seller will not be held liable should the
customer provide an incorrect address and contact information or
enter erroneous article names or quantities. All sales of our wines
and spirits are contingent upon current inventory availability.
Payment
The
Cave de Bissey has equipped its site with one of the Internet's
most reliable security systems for credit card payment. The information
entered is protected and encrypted prior to transmission. While
this means of payment is simplest and quickest, the customer may
also elect to print the order and send it to us by post, along with
a check for the order amount. Under all circumstances, the order
will only be processed and delivered once payment in full has been
received. An invoice will be drawn up and sent to the customer at
the indicated billing address. In compliance with Articles 115 to
122 of a French law enacted on January 25, 1985, merchandise ordered
will remain our property until payment in full has been received.
Prices
Prices
of our products are listed in euros, inclusive of tax (current VAT
stands at 19.6%). The prices indicated in the order confirmation
are definitive and include packaging and handling.
Shipping charges
The
fee charged for shipping has been set at 15 euros (inclusive of
tax). This fee will be waived for purchases of 24 bottles or more.
Delivery and acceptance of goods
Wines are delivered
in either 6- or 12-bottle cases, with the entire order quantity
being shipped all at once and to a single address. The Cave de Bissey
agrees to employ any and all available means to ensure delivery
as quickly as possible. Nonetheless, any ultimate delivery delays
do not constitute grounds for the customer to cancel the sale, refuse
the merchandise or submit a claim for damages and interest due especially
to Acts of God, war, rioting, fire, labor strikes or any other event
beyond our control. The merchandise is always shipped at the recipient's
entire risk even when traveling postage-paid. The purchaser is strongly
advised to verify contents of the order upon reception. Any complaint,
reservation or claim of faulty products must be indicated on the
delivery form. Should product content be faulty and upon our consent,
a replacement order will be processed.
Litigation
Any
purchase claim or protest must be submitted in writing to the following
address: Cave de Bissey - Les Millerands - 71390 Bissey-sous-Cruchaud
- France. Should a legal proceeding ensue, an amicable solution
will be sought first; eventual recourse will be addressed to the
Chalon Business Court, which alone has jurisdiction to issue a ruling.
Right of order cancellation
In
accordance with the conditions stipulated in French Consumer Code,
the customer will be given a 7-day order cancellation period beginning
on the delivery date to return the merchandise and request reimbursement
in full, without any penalty being applied apart from payment of
return shipping charges.
Access to customer records
In
accordance with the Freedom of Information Law, the customer is
given the right to access and correct all pertinent customer data
held as well as the right to revoke data records. In order to claim
these rights, a written request must be filed with the Cave de Bissey.
Customers are advised that the Cave de Bissey neither sells nor
distributes its customer data records.
